Octopoddy Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Octopoddy mobile application and related services (collectively, the "Service"), operated by Octopoddy Pty Ltd (ABN: 88 691 378 177) ("Octopoddy," "we," "us," or "our").

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

The Service is not directed to children under 13. You may not use the Service if you are under 13. If you are under the age of majority where you live, you represent that you have permission from a parent or legal guardian.

2. The Service and Third-Party Content

Octopoddy is a podcast listening application that allows users to access podcasts distributed via public RSS feeds and third-party hosting providers.

2.1 No Ownership of Podcasts

Podcasts, artwork, names, trademarks, and related content ("Podcast Content") are owned by their respective creators/publishers. Octopoddy does not claim ownership of Podcast Content.

2.2 Availability and Accuracy

We do not guarantee that any podcast, episode, feed, link, or metadata will be available, accurate, complete, lawful, or uninterrupted.

3. Accounts, Identifiers, and Support

Octopoddy does not require you to provide an email address to use the Service. The Service may use a service identifier (for example, an internal user ID and/or an identifier associated with your device or sign-in method if used) to provide functionality such as subscription entitlements and syncing (where enabled).

If you contact us for support, you may provide contact information (such as an email address), and we will use it to respond to you.

4. Octopoddy Pro and Subscriptions

Some features are available only with a paid subscription ("Octopoddy Pro"), including AI-assisted ad-skipping and server-assisted playback/download.

Subscriptions are billed and managed through the Apple App Store. Your purchase, renewal, cancellation, and refunds are subject to Apple's terms and policies.

We may change Pro features, pricing, or availability at any time as permitted by law and App Store rules.

5. AI-Assisted Ad-Skipping and Smart Playback (Pro Feature)

Octopoddy Pro may include an optional feature designed to help users skip segments that may contain advertising, sponsorships, or promotional content ("Ad-Skipping").

5.1 What Ad-Skipping Does (and Does Not Do)

  • Ad-Skipping does not modify, edit, or permanently alter podcast audio files.
  • The Service may provide playback guidance (for example, segment markers or skip timing) and the app may adjust playback position on your device.
  • Ad-Skipping can be disabled via a toggle in the app.
  • You can override playback by manually seeking. Seeking backward may replay previously skipped segments, and seeking forward may move past detected segments depending on timing.

5.2 Best-Effort, Not Guaranteed

Ad-Skipping is a best-effort feature. It may:

  • miss ads entirely,
  • skip too much (including non-ad content),
  • skip too little,
  • or be slightly inaccurate in timing.

You acknowledge and accept that Ad-Skipping may affect your listening experience.

5.3 Experimental / Alpha

The Service (including Ad-Skipping) is provided in alpha/early access form. Features may be unstable, change frequently, or be removed.

6. Server Processing and Caching (Pro Feature)

When you use certain Pro features (including Ad-Skipping and server-assisted playback/download), Podcast Content may be processed through our systems.

6.1 What We Process

Depending on the feature used, we may:

  • download podcast audio to our servers,
  • generate derived data from audio to provide requested features (for example, analysis metadata used to identify segments that may contain ads or promotional content),
  • temporarily store audio and derived data,
  • deliver audio to your device for local playback (unmodified).

6.2 Storage Duration

We may retain audio and derived data only as long as reasonably necessary for purposes such as:

  • providing the Service you requested,
  • performance optimisation,
  • security and fraud prevention,
  • troubleshooting and quality improvement,
  • legal compliance.

Retention practices may change over time.

6.3 Infrastructure and Location

Processing may occur on:

  • Octopoddy-controlled servers, and/or
  • third-party infrastructure providers (for example, cloud hosting).

Octopoddy servers are currently located in the United States, and third-party providers may operate in additional jurisdictions. By using the Service, you consent to processing and storage of data in these locations.

7. Analytics and Service Improvement

We may collect analytics such as:

  • playback events (for example, when something is played),
  • Ad-Skipping events (for example, when segments were skipped),
  • app interactions and feature usage,
  • diagnostics such as crash reports and error logs.

We use this information to improve reliability, security, and performance.

8. Acceptable Use

You agree not to:

  • reverse engineer, decompile, or attempt to extract source code (except where prohibited by law),
  • interfere with or disrupt the Service,
  • use the Service to violate laws or third-party rights,
  • bypass paywalls, access controls, or security features.

9. Intellectual Property (Octopoddy)

The Service, including its software, design, trademarks, and branding (excluding Podcast Content), is owned by Octopoddy and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable license to use the app for your personal, lawful use.

10. Disclaimers

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available."
  • We do not guarantee uninterrupted operation, perfect accuracy, or error-free performance.
  • We do not guarantee that ads will be identified or skipped.
  • We are not responsible for Podcast Content, including any errors, offensiveness, availability, or legality of such content.

11. Limitation of Liability (AUD $0 Cap Where Permitted)

11.1 Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict, or modify any rights you have under the Australian Consumer Law ("ACL") or other rights that cannot be excluded by law.

11.2 $0 Liability Cap (Maximum Extent Permitted)

To the maximum extent permitted by law, Octopoddy will have no liability to you arising out of or relating to the Service, and our total aggregate liability is AUD $0.

11.3 Excluded Losses

To the maximum extent permitted by law, Octopoddy is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or business interruption, even if we have been advised of the possibility of such damages.

11.4 If Liability Cannot Be Excluded

Where liability cannot be excluded under applicable law (including under the ACL), Octopoddy's liability is limited to the minimum extent permitted by law.

12. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will take reasonable steps to provide notice, such as by:

  • posting updated Terms in the app or on our website,
  • showing an in-app notice,
  • or otherwise notifying you.

Your continued use of the Service after the effective date of updated Terms constitutes acceptance. If you do not agree, you must stop using the Service.

13. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we reasonably believe it is necessary to protect the Service, users, or third parties.

You may stop using the Service at any time.

14. Governing Law and Exclusive Jurisdiction

These Terms are governed by the laws of New South Wales, Australia.

Subject to any non-excludable rights you may have under applicable law, you and Octopoddy submit to the exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.

(Exclusive jurisdiction is commonly used because it provides more certainty about where disputes will be heard.)
